Subject matter and basics of data protection

The subject of data protection is personal data. This is all information that relates to an identified or identifiable natural person (so-called data subject). This includes, for example, information such as name, postal address, e-mail address or telephone number, but also information that necessarily arises during the use of our website, such as information about the beginning, end and extent of use and the transmission of your IP address.

We process personal data in compliance with the relevant data protection regulations. This means that your data will only be processed by us if you have given your consent or if we are legally permitted to do so, e.g. if data processing is necessary to provide our contractual services (e.g. processing of orders) or is required by law, or on the basis of our legitimate interests as defined in Art. 6 (1) f) DSGVO (e.g. our interest in analyzing, optimizing and securely operating our online offering).

Data processing when calling up our website

The use of our website is generally possible without registration and without providing personal data. However, even if you use our website in this way for purely informational purposes, personal data may be automatically collected and processed. Below you will find an overview of the type, scope, purposes and legal basis of data processing via our website.

3.1 Provision of our website

When you access our website through your terminal device, we automatically record and process the following data in the server log files:

When you call up our website, this data is automatically processed. Without this provision, you cannot use our website. We do not use this data for the purpose of drawing conclusions about your identity.

The collected data is usually deleted after 28 days, unless we exceptionally need it longer for the above purposes. In such a case, we delete the data immediately after the purpose ceases to apply.

3.2 Display technologies

This website uses so-called web fonts for the uniform display of fonts. External fonts, Google Fonts, are used for this purpose. Google Fonts is a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). The integration of these web fonts is done by a server call, usually a Google server in the USA. When you call up a page, your browser loads the required web fonts into its browser cache in order to display texts and fonts correctly.

On this website, we also use Ajax and jQuery technologies, which optimizes loading speeds. In this regard, program libraries are called from Google servers. Google's CDN (content delivery network) is used. If you have previously used jQuery on another page from Google CDN, your browser will fall back to the cached copy. If this is not the case, this will require a download, whereby data from your browser will reach the provider Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google").

For this purpose, the browser you use must connect to Google's servers. Through this, Google obtains knowledge that our website was accessed via your IP address. The use of Google's display technologies is in the interest of a uniform and appealing as well as error-free presentation of our online offer. In order to offer you an extensive range of functions on our website, to make it more comfortable to use and to be able to optimize our offers, we use so-called "cookies". 3.4 Analysis services

In order to optimize the services and functions of our website and to offer them in the best possible way, we perform the analyses of visitor behavior described below. The purpose of the data processing is, in addition to troubleshooting, primarily the optimization of our website with regard to the needs of the users. We also obtain key figures about the volume of visitors and their distribution over time, about popular content and the length of time users spend on the site via the web analysis process. It may also be possible to determine whether a user profile was created as a result of an advertising measure. The data is processed and used to prevent and combat fake profiles, illegal activities and spam, and to increase the security of the website. To perform the analysis, user data is transmitted to various third-party providers as described here in the privacy policy.

a) We use Google Analytics, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google") on the Website. Google uses cookies, the information generated by the cookie about the use of the online offer by users is usually transmitted to a Google server in the U.S. and stored there. Google uses this information on our behalf to evaluate the use of our website, to compile reports on the activities within our online offer and to provide us with other services related to the use of our online offer. In doing so, pseudonymous usage profiles can be created from the processed data.

We only use Google Analytics with IP anonymization activated. This means that the IP address of the user is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. The IP address transmitted by your browser will not be merged with other data from Google.

The data processing associated with Google Analytics takes place on the basis of your consent pursuant to Art. 6 para. 1 lit. a ) DSGVO.

When weighing up, it should also be taken into account that acceptance of Google Analytics is not mandatory when using our website. If you do not want cookies to be stored by Google Analytics on your terminal device, you can prevent this through your privacy settings in the category "Statistics" (Here you can access the corresponding cookie settings). You can also deactivate the corresponding option in the system settings of your browser. You can delete stored cookies in the system settings of your browser at any time. The data processed within the scope of Google Analytics is deleted - according to Google's own information - after 14 months. Insofar as data is transferred to the USA, so-called standard contractual clauses in accordance with Art. 46 DSGVO for Google advertising services have been concluded with Google as suitable guarantees (https://privacy.google.com/businesses/processorterms/mccs/). Google is also certified under the Privacy Shield agreement. b) We use Hotjar, an analysis software of Hotjar Ltd, 3 Lyons Range, 20 Bisazza Street, Sliema SLM 1640, Malta ("Hotjar"), to better understand the needs of our users and to optimize our offer. Using Hotjar's technology, we get a better understanding of our users' experiences (e.g., how much time users spend on which pages, which links they click on, what they like and don't like, etc.) and this helps us tailor our offering based on our users' feedback. Hotjar works with cookies and other technologies to collect information about our users' behavior and about their devices, in particular:

  • IP address of the device (collected and stored only in anonymized form)
  • Screen size
  • Device type (unique device identifiers)
  • Information about the browser used
  • Location of the user (country only)

3.5 Social media and social networks

The website contains links to our accounts on social networks such as Instagram, YouTube, Twitter, Facebook. After clicking on the embedded graphic, you will be redirected to the page of the respective provider, i.e. only then will user information be transmitted to the respective provider. If you are logged into the corresponding social network with your user profile, an association with the visit to our website takes place after activating the button. If you do not want the social networks to collect data about the website, you should log out of these accordingly before visiting the website.

3.6 Integration of YouTube videos

We have embedded YouTube videos on our website, which are hosted by YouTube but can be played directly from our website. YouTube is a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). This service is inactive by default, but can be activated by the user. If you call up a sub-page on our website with an embedded YouTube video, general framework data such as your IP address can be transmitted back to Google through the embedding technology. Google processes the IP address of users because without the IP address they cannot send the content to their browser. If you consent to the data transfer to Google, we have no influence on how Google uses the data. Google may, for example, use so-called pixel tags for statistical or marketing purposes. The "pixel tags" can be used to evaluate information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on the user's device and may contain, among other things, technical information about the browser and operating system, referring websites, time of visit and other information about the use of our online offer. YouTube may store your data as usage profiles and use them for the purposes of advertising, market research and / or tailored design of their offers. 3.7 Google Maps

On our website, we also use Google Maps (API), another service of Google LLC. Google Maps is a web service for displaying interactive (land) maps in order to visually present geographical information.

Already when calling up those sub-pages in which the map of Google Maps is integrated, information about your use of our website is transmitted to Google servers in the USA and stored there, this applies in particular to your IP address. This occurs regardless of whether you have a Google user account and are logged into it, or whether there is no user account. If you are logged in to Google, your data may be assigned directly to your account.

The data processing is based on our legitimate interests, namely our interest in the analysis, optimization and operation of our online offer within the meaning of Art. 6 para. 1 lit. f) DSGVO. Google is certified under the Privacy Shield agreement and thereby offers a guarantee of compliance with European data protection law. 3.8 Online advertising (retargeting/remarketing)

We also use retargeting/remarketing services from third-party providers to optimize our offer on the website. For this purpose, data is collected on the website on the basis of cookie/tracking technology to optimize advertising and the entire online offering. This data is not used to identify you personally, but is used solely to evaluate the use of the website and to target users who have already shown interest in content and offers with interest-based advertising on the website and on other websites and social media offers of our partners. The insertion of advertising on the website or on the websites of partners is based on an analysis of previous usage behavior. According to the providers of the services used, usage profiles are generally created anonymously or pseudonymously. We also do not combine this data with other stored personal data at any time. Which third-party providers we work with, how user data is processed in this context and how you can deactivate retargeting/remarketing technologies are explained in the following sections.

a)The website uses Google Ads (formerly Google AdWords). Ads is an online advertising program of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). Within the framework of Google Ads, we use so-called conversion tracking. When you click on an ad placed by Google, a cookie is set for conversion tracking. These cookies do not serve to identify the user. However, if you visit certain pages of this website and the cookie has not yet expired, Google and we can recognize that you clicked on the ad and were redirected to this page. The information collected using the conversion cookie is used to create conversion statistics for Ads customers who have opted in to conversion tracking. Clients learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive information that can be used to identify individual users. If you do not wish to participate in the tracking, you can object to its use by deactivating the Google conversion tracking cookie via your internet browser under user settings. You will then not be included in the conversion tracking statistics.

b) We also use the online marketing tool Campaign Manager (formerly Google DoubleClick) of the provider Google on our website. Campaign Manager uses cookies to present you with advertisements that are relevant to you. Campaign Manager is characterized by the fact that ads are displayed in real time based on the presumed interests of the user. When our website and other websites on which the Google advertising network is active are called up, a code is executed by Google and so-called (re)marketing tags are integrated into the website. With their help, an individual cookie is stored on the user's device, in which it is noted which web pages the user has visited, as well as technical information about the browser and operating system, referring web pages, time of visit and other information about the use of the online offer. The IP address of the user is also recorded, whereby this is shortened within the Member States of the European Union or another state party to the Agreement on the European Economic Area and only in exceptional cases is it transferred in full to a Google server in the USA and only shortened there. User data is processed pseudonymously within the Google advertising network, i.e. Google does not store and process the name or email address of the user, but processes the relevant data cookie-related within pseudonymous user profiles. This does not apply if a user has expressly allowed Google to process the data without this pseudonymization.

c) Within our website, the so-called Facebook pixel of the social network Facebook, which is operated by Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook"), is used. With the help of the Facebook pixel, it is possible for Facebook, on the one hand, to determine the visitors to our online offer as a target group for the display of advertisements (so-called "Facebook ads"). Accordingly, we use the Facebook pixel to display the Facebook ads placed by us only to those Facebook users who have also shown an interest in our offer or who have certain characteristics (e.g. interests in certain topics determined on the basis of the websites visited) that we transmit to Facebook (so-called "Custom Audiences"). With the help of the Facebook pixel, we also want to ensure that our Facebook ads correspond to the potential interest of users and do not have a harassing effect. With the help of the Facebook pixel, we can further track the effectiveness of the Facebook ads for statistical and market research purposes by seeing whether users were redirected to our website after clicking on a Facebook ad (so-called "conversion"). 
The use of Facebook technologies on our website is based on your consent pursuant to Art. 6 para. 1 lit. a) DSGVO. We will only use the data obtained to advertise our products and will not pass it on to third parties.

You can also prevent the collection by the Facebook Pixel and the use of your data to display Facebook Ads. In order to set which types of advertisements are displayed to you within Facebook, you can visit the page set up by Facebook and follow the instructions there regarding the settings for usage-based advertising.

Facebook is also certified under the Privacy Shield agreement.

d) On our website, we use the conversion tracking technology of the provider LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland ("LinkedIn"). LinkedIn's technology allows us to show you more relevant advertisements based on your interests. We also receive aggregated and anonymous reports from LinkedIn of ad activity and information about how you interact with our website. For this purpose, LinkedIn uses a Javascript code (Insight tag), which in turn places a cookie in your web browser or uses a pixel. Via the LinkedIn Insight tag, data about the use of our website is collected, including URL, referrer URL, IP address, device and browser properties, timestamps and page views. LinkedIn does not share personally identifiable information with the website owner, but only provides aggregate reports about website audience and ad performance. 
The use of LinkedIn technologies on our website is based on your consent pursuant to Art. 6 (1) a) DSGVO. 

In connection with the use of LinkedIn Conversion Tracking, the information collected is also processed on servers of LinkedIn Inc. in the USA. Insofar as data is transferred to the USA, so-called standard contractual clauses pursuant to Art. 46 DSGVO have been concluded with LinkedIN as suitable guarantees. LinkedIn is also certified under the Privacy Shield agreement.

3.9 Google reCAPTCHA

We use the reCAPTCHA function of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google") on our website. This function is primarily used to distinguish whether an input is made by a natural person or abusively by machine and automated processing. The service includes the transmission of your IP address and, if applicable, further data required by Google for the reCAPTCHA service to Google and is carried out in accordance with Art. 6 para. 1 lit. f) DSGVO on the basis of our legitimate interest in determining the individual, willful access to our online offer and the prevention of abuse and spam. Google is certified under the Privacy Shield agreement and thereby offers a guarantee of compliance with European data protection law. 3.10 Google Tag Manager

For reasons of transparency, we would also like to point out that we use Google Tag Manager on our website. Google Tag Manager is a solution with which website operators can manage website tags via a uniform interface and thus integrate Google services in particular into their offering. The Google Tag Manager itself (which implements the tags) does not collect or process any personal data.

In addition to the purely informational use of our website, we offer various services or functions that you can use if you are interested. For this purpose, you usually have to provide further personal data, which we use to provide the respective service or function as described below.

4.1 Registration for the "fischertechnik Fan Club"

Users have the opportunity to register on the "Fan Club" portal, create an account and use various digital services via this account. The portal is a closed area of the website, which is only accessible to users after prior approval. When registering and creating your account, you will be asked to provide the following mandatory information, which is marked with an "*":

Without providing this mandatory data, registration and account creation are not possible. We process the mandatory data provided by you on the basis of Art. 6 para. 1 lit. b) and f) DSGVO, on the one hand to create your profile and to identify you at each login, and on the other hand to compare and link your data with the data we have in our CRM system. Depending on the service and function you use on the portal, further data may be collected and subsequently linked to your existing profile data.

In the course of your registration, you also have the option of providing further information on a voluntary basis, e.g. specifying your telephone number or website. These details are not required for registration and the creation of the partner account. However, if you do not provide this information, we may not be able to fully accommodate your requests when using the account. If you provide such voluntary information, the processing of this data is based on our legitimate interests in the administration and maintenance of our customer relationships and the optimization of our online services. In this respect, the legal basis is Art. 6 para. 1 lit. f) DSGVO.

If, in the course of registration, you agree to fischertechnik sending you advertising by e-mail, we will process your data in order to send you information on interesting products or services relating to fischertechnik products on this basis. The legal basis is then your consent in accordance with Art. 6 Para. 1 lit. a) DSGVO. You can revoke your consent at any time. A short message to us is sufficient for this purpose. For more information, please refer to the section on data subject rights below in item 8.

4.2 Trainings/Seminars

On the website, you have the option of registering for our numerous training courses and seminars. When you register, the following mandatory information is requested and stored by means of a form:

  • First name
  • Last name
  • Phone number
  • e-mail address
  • Company name
  • Address details

Without providing this mandatory data, registration for our seminars is not possible. In the course of registration, you also have the option of voluntarily providing further information such as title, department, etc. Please note that this information is not required for registration and you alone decide whether you wish to provide this data. We process the collected data on the basis of Article 6 para. 1 lit. b) DSGVO in order to create you with your account, to identify you and to fulfill the usage contract with you. We delete the data provided by you as soon as the purpose of collection ceases to apply completely and no further legal basis intervenes (e.g. further processing of the data is or becomes necessary for the fulfillment of a concluded contract). If and as long as there are legal obligations to retain data, we will delete the data only after the relevant periods have expired.

4.3 Newsletter

To register for our newsletter, it is sufficient to enter your name and e-mail address. We only send newsletters after corresponding registration, i.e. with your consent on the basis of Art. 6 Para. 1 lit. a) DSGVO. Insofar as the contents of the newsletter (i.e. the advertised goods and services) are specifically described in the registration, they are decisive for the scope of the consent. In addition, our newsletters contain information about our products, offers, promotions and / or our company.

When registering for the newsletter, you must confirm that you have reached the age of 16. The registration takes place by means of the so-called double-opt-in procedure, i.e. after your registration you will receive an e-mail in which you are asked to confirm your registration in order to prevent the misuse of your e-mail address. We log the registration for the newsletter in order to be able to prove the registration process in accordance with the legal requirements and, if necessary, to prevent or clarify any misuse of your personal data. The logging of the registration process is based on our legitimate interests pursuant to Art. 6 para. 1 lit. f) DSGVO in the operation of a user-friendly and secure newsletter system and to be able to prove the registration process and the consent given later.

You can revoke your consent to receive our newsletter at any time, in particular by unsubscribing from the newsletter. You will find an unsubscribe link to exercise this right at the end of each newsletter. If you have only subscribed to our newsletter, your personal data will be deleted again if you unsubscribe.

Our newsletters contain so-called tracking pixels (web bugs), which enable us to recognize whether and when an e-mail was opened and which links in the e-mail were followed by the personalized recipient. We store this data so that we can optimally tailor our newsletters to the wishes and interests of our subscribers. Accordingly, the data thus collected is used to send personalized newsletters to the respective recipient.  

We ask for your consent in this regard at the appropriate point. With the revocation of the consent to receive the newsletter, the consent to the aforementioned tracking is also revoked.

4.4 Data processing for the implementation of competitions

If you participate in sweepstakes, we process personal data that we receive from you, e.g. name, e-mail address and other data, to enable participation in the sweepstakes. In the context of the sweepstakes, we will inform you which of your details are required for participation.
The processing of the data serves the provision, implementation and handling of sweepstakes. We process personal data of participants in sweepstakes and contests only in compliance with the relevant data protection provisions. The legal bases for data processing are Art. 6 (1) lit. b DSGVO related to data processing for the implementation of the sweepstakes and otherwise Art. 6 (1) lit. f DSGVO, insofar as the processing serves our legitimate interests (e.g. in the security of the sweepstakes; in the protection of our interests against misuse through possible recording of IP addresses when submitting sweepstakes entries or for reporting in online and offline media). Insofar as we ask for your consent in the context of the sweepstakes, e.g. to send advertising by e-mail or to publish your photo, and you give us your consent to do so, the legal basis for this processing is Art. 6 (1) lit. a DSGVO.
Participants' data will only be transferred to other entities if this is necessary for the implementation of the competition (e.g. for the purpose of sending prizes) and there is a legal basis for this or a participant has consented to the transfer. External recipients may include, in addition to other fischer companies, external service providers who support us in the implementation of the sweepstakes as our order processors. These processors are carefully selected by us and regularly audited. They may only use the data for the purposes specified by us and in accordance with our instructions.
The participants' data will be deleted when the data is no longer required to carry out the competition and we no longer need the data to achieve the purposes outlined. Processing of the data beyond the end of the competition may arise in particular if we answer queries about the prizes or fulfill the prize obligations; in this case, the retention period also depends on the type of prize and may be up to three years, in particular in the case of goods or services, in order to be able to process warranty cases, for example. Furthermore, the participants' data may be stored for longer in individual cases, e.g. in the case of reporting on the competition in online and offline media. If data was also collected for other purposes as part of the sweepstakes, its processing and the retention period depend on the conditions for this use (e.g. for registration for the newsletter as part of a sweepstakes, see the data protection information for the newsletter under section 4.3 ).

4.5 Other contact - contact form

If you provide us with personal data by e-mail or via a contact form, this is always done on a voluntary basis. Your information will be processed by us for the purpose of handling your contact request and its processing or for order processing in accordance with Art. 6 Para. 1 lit. b) DSGVO and may also be passed on to affiliated companies or third parties in this context. To this extent, the information may also be stored by us in our Customer Relationship Management (CRM) system. The provider of our CRM is the company Sitecore, 101 California Street Floor 16, San Francisco, CA 94111. We delete the data provided by you as soon as the purpose of collection ceases to apply completely and no further legal basis intervenes (e.g. further processing of the data is or becomes necessary for the performance of a concluded contract). If and as long as there are legal obligations to retain data, we will delete the data only after the relevant periods have expired.

When users leave comments or other contributions on our website, their IP addresses are stored for 180 days on the basis of our legitimate interests as defined in Art. 6 (1) f) DSGVO. This is done for our security in case someone leaves unlawful content in comments and posts (insults, prohibited political propaganda, etc.). In this case, we ourselves may be legally responsible for the comment or post and are therefore interested in the identity of the author.

Recipients of personal data

Within our company, only those persons have access to personal data who need it for the purposes stated in each case. We only pass on your personal data to external third parties if this is necessary to process or handle your request, if there is other legal permission or if we have your consent to do so.

Data transfer within our group of companies takes place for sales and marketing purposes on the basis of our legitimate interests in accordance with Art. 6 Para. 1 lit. f ) DSGVO.

External recipients may include, in particular, affiliated companies or external service providers that we use as our processors for the provision of services, for example in the areas of technical infrastructure and maintenance of our website. These processors are carefully selected and regularly reviewed by us. They may only use the data for the purposes specified by us and in accordance with our instructions.
